General individual rights

The “Allgemeine Persönlichkeitsrecht” [roughly: German privacy law] promises a person the right to their own image and the right to their own spoken words. Consequently, for the publication of photos or film recordings a declaration of consent is needed from the people concerned. This does not absolutely have to be written consent; cooperative behaviour or an oral agreement also count as declaration of consent. Nevertheless, it is advisable that institutions obtain written consent!

No declaration of consent is needed if people are only in the picture by chance, i.e. part of the total picture, and not distinguished in any other way.

Example: if general film or photographs are made of the campus, people on the campus are part of the scene as a whole, unless one or more people stand out from the general view.
